JUDGMENT / ORDER

The petitioner herein is the 7th accused in S.C No.632/2014 of the Court of Session, Thalassery. Pending the proceeding he made an application for a direction to issue passport. He has some employment opportunities abroad, and he wants to go abroad to join that employment. The learned Additional Sessions Judge dismissed the application on the ground that if the petitioner goes abroad, it will obstruct trial of the case. The said order is under challenge in this proceeding. The petitioner seeks a direction to the concerned authority to issue passport. It is submitted that the parties have in fact amicably settled the whole dispute and proceedings are pending before this Court to quash the crime, and also the counter case. The petitioner and the other accused have brought Crl.M.C No.1580/2014 to quash the prosecution on the ground of amicable settlement. The injured person has also filed affidavit in the proceeding that the matter stands settled. It is submitted that there is another Crl.M.C to quash the proceeding in the Crl.M.C No.6776 of 2014 2 counter case also. I am well satisfied that the parties have really settled the dispute. In the above circumstance, passport can be issued to the petitioner in the interest of justice.
In the result, this Criminal Miscellaneous Case is allowed. The impugned order is set aside and the petitioner herein is permitted to apply for passport before the proper authority.
