Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed challenging the impugned suspension order dated 30.10.2019 passed by the respondent no. 2.
Learned counsel for the petitioner sought to argue the matter on merits challenging the merits of the suspension order.
The petitioner has already submitted his reply to the show cause notice. All such grounds on merits can be suitably considered by the authority concerned. As such, I am not inclined to entertain the present petition.
Accordingly present petition stands disposed of with a direction to the respondent no. 2-Sub Divisional Magistrate, Tehsil Sadar, District Rampur to consider the reply of the petitioner and pass appropriate orders on its own merit strictly in accordance with law, preferably within a period of one month from the date of production of certified copy of this order.
It is made clear that this Court has not considered the merits of the claim of the petitioner.
No order as to costs.
