A.Syed Niyas vs The Director General Of ...

Madras High Court|02 February, 2017

JUDGMENT / ORDER

The petitioner has come up with this Writ Petition seeking a direction to the respondents to provide him National Trade Certificate for the successful completion of Electrician Course in the 3rd respondent's Institution.
2. According to the petitioner, he successfully completed two-year Electrician course in the 3rd respondent's Institution and came out successful in the examination held in the month of July 1997. He was issued with a Provisional National Trade Certificate on 17.11.1997 and in the said Provisional Certificate, it is stated that National Trade Certificate will be issued by the National Council for Vocational Training. Since the said Certificate was not issued to the petitioner, he made several representations to the respondents seeking issuance of the same. Since no reply is forthcoming from the respondents, the petitioner is before this Court.
3. Heard the learned counsel on either side and perused the material documents available on record.
4. Learned counsel for the petitioner submitted that a similarly placed candidate in respect of the 3rd respondent's Institution, viz. U.Murugan, who had completed Electrician course in the same year filed a Writ Petition in W.P.No.112 of 2008 and this Court passed final orders on 14.02.2013, allowing the said Writ Petition, directing the 1st respondent therein to issue NTC Certificate to the said U.Murugan. Hence, he pleaded that the petitioner's representation may be directed to be considered in respect of issuance of NTC Certificate to him.
5. Taking note of the said submission and considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, this Court directs the respondents herein to consider the petitioner's representations dated 19.12.2013 and 10.03.2014 seeking issuance of NTC Certificate, on merits and in accordance with law, and pass necessary orders, as expeditiously as possible.
This Writ Petition is disposed of with the above direction. No costs.
