The petitioners claim that petitioner no.1 is an association of Boring Technicians. It is stated that it is recognized by the State Government. A copy of the Rules of the Society is on the record as annexure-1 to the writ petition.
The grievance of the petitioners is that the petitioner-association has taken a resolution on 08.12.2016 for amending its Rules/bye-Laws and to conduct the election in terms of the amended Bye-Laws. However, the said Rules/bye-Laws has not been considered by the respondent no.2 till today.
The only prayer made by the petitioners is that the representation, which they have made for redressal of their grievance may be directed to be considered by respondent no.2 expeditiously.
We have heard the learned counsel for the petitioners and the learned Standing Counsel. With their consent the matter is taken on the Board for final disposal at this stage in terms of the Rules of the Court.
Having due regard to the facts of the case we are of the view that the ends of justice would be subserved by issuing a direction to the respondent no.2 to take appropriate decision on the representation dated 11.04.2018 expeditiously in accordance with law.
It is made clear that this Court has not expressed its opinion on the merit of the case. The respondent no.2 shall pas an order independently in accordance with law.
Accordingly, the writ petition is disposed of.
