JUDGMENT / ORDER

Heard Mr.Jigar P. Raval, learned advocate for the petitioner. It is submitted by him that the petitioner has purchased the property in question, after being the highest bidder in the tender floated by the Tourism Corporation of Gujarat for a consideration of Rs.3,25,001/-. That the Information, Broadcasting and Tourism Department of the State Government has accorded sanction to the sale of the property in favour of the petitioner. Thereafter, pursuant to order dated 16.11.2011 passed by the Collector, the mutation entry in favour of the petitioner, pursuant to the above sale was cancelled on the ground that the Tourism Corporation of Gujarat was not the owner of the land. It is further submitted that against the said order the petitioner has preferred a Revision Application that is pending. However, the application for grant of stay has been rejected by the impugned order, without taking into consideration the aspect that the sale transaction had been accepted by the State Government. It is further contended that if a stay order is not granted, the land may be given to somebody else by the State Government making the Revision Application infructuous. It is submitted that the sale transaction took place in 05.07.1997 and land has been transferred by the State Government to the Tourism Corporation of Gujarat vide order dated 03.11.2007 of the Collector, Banaskantha.
Issue Notice returnable on 20.06.2012.
Status-quo, as it exists today, qua the land in question, shall be maintained till then.
