Shivasharanapa Patil and others … Respondents THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL NO.1086 OF 2011 JUDGMENT: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) After hearing the learned counsel for the appellants, we have been able to understand undisputedly that by passage of time the subject matter of the writ petition itself has become infructuous, as the term of office of the trustees has been expired. As the writ petition itself has become infructuous, consequently no grievance inter se between the parties subsists any longer. Therefore, this appeal, which is filed against an interlocutory order in the writ petition, is dismissed as infructuous. There will be no order as to costs.
Consequently, pending miscellaneous petitions, if any, shall also stand dismissed.
The writ petition will appeal in usual course.
