JUDGMENT / ORDER

Heard Sri Mayank Agrawal, learned counsel for the petitioner and Sri Rajesh Tiwari, learned counsel for the respondents.
Petitioner is aggrieved by the notice by which certain liability upon the petitioner has been fixed. Petitioner earlier challenged the Notification dated 24.04.2007 by filing a Writ Petition No.32542 of 2007 that was finally disposed of directing the respondent-Corporation to look into the grievances of the petitioner. Petitioner submits that no facility has been provided, therefore, there cannot be any liability. In my opinion, these questions cannot be considered and decided by this Court in view of the fact that petitioner is admitting the applicability of the Act. Therefore, if petitioner is having any grievance regarding the facility to be provided in pursuance of the earlier order, it can submit a reply and raise a grievance before the competent authority. This Court cannot adjudicate these questions in the present writ petition.
In view of the aforesaid fact, no interference is called for. However, it is open to the petitioner to file a detailed representation before the competent authority and if such representation is filed that may be considered strictly in accordance with law by the relevant authority.
The writ petition is disposed of accordingly.
No order as to costs.
