A.Somarajan vs State Of Kerala

High Court Of Kerala|23 May, 2014
|

JUDGMENT / ORDER

1. The petitioner is a former employee of the Kerala Water Authority. He retired from service on attaining the age of superannuation on 31.03.2010. After his retirement, salary and allowances of employees of the Kerala Water Authority were revised with effect from 01.07.2009. As a result thereof, there was some delay in settlement of his pensionary benefits. The pensionary benefits as per the pre-revised scale of pay which was in force at the time of the petitioner's retirement was however later fixed and disbursed to him. The grievance voiced in the instant writ petition is that the pensionary benefits payable consequent on the revision of pay and allowances have not been paid. Yet another complaint is that from March, 2014 onwards, even the monthly pension is not being disbursed.
2. When the writ petition came up for hearing today, Sri.George Mathew, learned standing counsel for the Kerala Water Authority submitted that the arrears of pension W.P.C.9808/14 2 payable to the petitioner will be paid within two weeks from today. As regards the revised pensionary benefits, learned standing counsel submitted that the revised pensionary benefits will be quantified and disbursed within a period of three months from today. In the light of the aforesaid submission I dispose of the writ petition with the following directions:
1. The respondent shall draw and disburse to the petitioner, arrears of pension from March, 2014 onwards within two weeks from today and shall continue to pay pension periodically and in time.
2. The terminal benefits payable to the petitioner shall be suitably revised as stated in Ext.P4 and arrears disbursed within a period of three months from today.
