O R D E R:
This contempt case was filed alleging non- implementation of the order dated 10.12.2013 passed by this Court in W.P.No.18791 of 2006. By the said order, the petitioner was given time to pay the balance amount demanded by the respondents in four monthly instalments commencing from first week of January 2014 and the respondents were directed to restore the power supply on payment of the said amount.
2. Learned counsel for the petitioner states that the petitioner paid the amount as directed by this Court and in spite of the same, the power supply was not restored. The learned counsel for the petitioner brought to the notice of this Court a subsequent notice dated 09.04.2014 issued by the respondents directing the petitioner to pay an amount of Rs.2,99,027/- towards pilferage amount for restoration of power supply.
3. In view of the said letter, liberty is given to the petitioner to challenge the same in separate proceedings. Since there is a separate notice demanding amount as a pre-condition for restoration of power supply, it cannot be said that the respondents have violated the order dated 10.12.2013 by not restoring the power supply.
4. Subject to the above observation, the contempt case is dismissed. No costs.
