Counter affidavit filed today is taken on record.
Heard Mohd. Iqbal Farooqui, learned counsel for the applicant, Sri I.P.Srivastava, learned A.G.A. for the State and perused the record.
It has been argued by learned counsel for the applicant that the applicant used to drop the prosecutrix and other women of the company in a factory where they were employed. It appears that the victim is a consenting party. The applicant is in jail since 16.4.2016.
Learned AGA opposed the prayer for bail and submitted that as per version of the F.I.R. as well as academic record, the victim is a minor, hence, the applicant is not entitled for bail. The trial is in progress.
Without expressing any opinion on the merits of the case and considering the submissions advanced, I find that no good ground is made out for enlarging the applicant on bail.
The bail application of the applicant Aslam, involved in case crime no. 500 of 2016, under Sections 363, 366, 376 IPC and 3/4 POCSO Act, P.S. Sihanigate, District Ghaziabad is, accordingly, rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within a period of six months from the date of production of certified copy of this order before the trial court.
The applicant is directed to produce the certified copy of this order before the trial court for it's compliance.
