Heard learned counsel for the applicant, Sri Vikas Sahai, the learned A.G.A. for the State and perused the record.
The present third bail application has been moved by the applicant to enlarge him on bail in Case Crime No. 365 of 2019, under Section 302 IPC, police station Nanauta, District Saharanpur.
This third bail application has been moved solely on the ground that P.W.-1 has turned hostile in the course of trial. Undisputedly P.W.-1 is not the solitary prosecution witness. The Court also bears in mind the nature of injuries which were inflicted on the victim and which were noticed earlier in the order dismissing the second bail application.
Accordingly and in view of the aforesaid, this application is rejected.
