Heard learned counsel for the applicant and learned A.G.A. for the State and perused the material on record.
Instant application under Section 482 Cr.P.C. has been filed with the prayer to direct learned District Magistrate, Kasganj to decide the objection dated 24.11.2020 moved by the applicant in Case No.00131 of 2020 (State of U.P. Versus Aslam) under Section 14(1) U.P. Gangster and Anti-Social Activities Act, 1986, Police Station Kasganj, District Kasganj, pending in the court of District Magistrate, Kasganj within a stipulated period.
Final order has been passed by the District Magistrate, Kasganj on 31.08.2020 with the observation that said vehicle i.e. U.P.87 T 2154 Innova Cresta Car was obtained through illegal means i.e. from the money earned from criminal offences like gambling, betting, sale of psychotropic articles and cow slaughter. Opportunity for filing objection was given by District Magistrate concerned to the applicant but despite notice the applicant never appeared before District Magistrate, Kasganj. Under the circumstances, the said vehicle was seized under provisions of U.P. Gangster and Anti-Social Activities Act, 1986. It is completely an administrative order. There is no ground for interference in the said order in invoking provisions of Section 482 Cr.P.C.
The application under Section 482 Cr.P.C. has no force and it is, accordingly, dismissed.
