Heard learned counsel for the plaintiff-petitioner.
The petitioner is before this Court assailing the order dated 6.11.2014 passed by Additional Civil Judge (Junior Division), Etawah by which he has rejected the application 26C and 34C filed in F.D. No.58 of 2008 (Mohd. Saddiq vs. Mohd. Mustafa).
This writ petition has been filed beyond period of three years and 163 days after lapse of period of limitation. Learned counsel for the petitioner has requested for condonation of this delay.
The petitioner has not sufficiently explained the delay in filing the writ petition and therefore, the request for condonation of delay is declined.
Accordingly, this writ petition is dismissed on the ground of delay and laches.
