Heard learned counsel for the petitioners, learned Standing Counsel for the State and perused the record.
The Hazarat Baba Hazrat Sadan Shah is an old registered Waqf property. There are 15 shops within the boundary of the land belonging to the Waqf. However, on the complaint of respondent nos.6, 7 and 8, the impugned order was passed on 30.12.2017 by the District Magistrate, Lalitpur-respondent no.2 by which all the shops were seized and stop to the members of Waqf from collection of rent from the shops From perusal of impugned order, it is clear that prima facie when it was found that it was a nazul land, then the impugned order was passed. Apart from that according to the petitioners, a civil suit is also pending.
Hence, it is not a fit case for interference in the impugned order.
Accordingly, the present writ petition is devoid of merit and the same is liable to be dismissed.
