Petitioner is holding a licence to run foreign liquor shop.
His grievance is that model shop has been allowed to run within 200 meters of his shop which is in violation of the rules.
Issue is one which requires investigation into the question of fact.
From the pleadings, we find that the petitioner has already made an application with respect to his grievances before the Collector/Licensing Authority, Agra.
Sri A.C. Tripathi, learned Standing Counsel appearing for the State-respondents fairly states that in case any such application made by the petitioner is pending, the same shall be considered and decided by the concerned authority expeditiously.
Considering the facts, we dispose of the writ petition by directing respondent no. 3-Collector/Licensing Authority, Agra to consider and take appropriate decision on the application dated 26.03.2018 in accordance with law and rules by means of a reasoned speaking order within a period of three weeks from the date of production of a certified copy of this order after notice and opportunity of hearing to all concerned.
