In the face of the objection raised by the learned Standing Counsel for the respondent Corporation, the learned counsel for the petitioner seeks the leave of this Court to withdraw the Writ Petition with liberty to approach an appropriate forum viz., Andhra Pradesh Administrate Tribunal, agitating the issue raised in this writ petition.
It goes without saying that once the cause survives even in the absence of any liberty from this Court, the petitioner does have a right to approach a proper judicial forum, especially when the Writ Petition is held to be not maintainable on the ground that an efficacious alternative remedy is available.
Accordingly, the Writ Petition is dismissed as withdrawn, giving liberty to the petitioner to approach an appropriate forum for remedy, if so advised. There shall be no order as to costs.
As a sequel, the Miscellaneous Petitions, if any, pending in this writ petition, shall stand disposed of as infructuous.
