Mehta, learned advocate for the opponent, has fairly submitted that if the request, as prayed for by the applicant in present application is granted, the opponent has no objection.
In view of the submissions made by learned counsel for the contesting parties and taking into account the reasons mentioned in the application, the order dated 4.10.2011 passed in Company Petition No.14 of 2006 is recalled.
Office is directed to restore the proceedings of Company Petition No.14 of 2006 to its original file and list it for further hearing before the appropriate Court in due course.
The application is allowed and stands disposed of accordingly.
