In view of order dated 30.9.2010 and the fact about filing of second FIR about 10 years of earlier one which resulted into acquittal of the applicants, at this stage a case is made out to issue Rule.

Learned APP, waives service of rule on behalf of respondent No.1 and Mr. U.M. Shastri, learned advocate, for respondent No.2.

Ad-interim relief granted earlier to continue till final disposal of the application.
