Heard Shri Rajiv Sisodia, learned counsel for the applicant and learned AGA for the State.
It has been contended by the learned counsel for the applicant that the applicant has not committed any offence and he has been falsely implicated in this case. The applicant is in jail since 31.12.2017.
Learned A.G.A has opposed the prayer for bail stating therein that the two injured persons namely Smt. Firdaus and Smt. Lajo in their statements recorded under section 161 Cr.P.C stated that the husband and other persons have come having point in Halua and all the family members have become unconscious and in the night assaulted at his daughter and wife. He further submits that the trial is in progress and two prosecution witness have already been examined.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Asif involved in Case Crime No.1223 of 2017, under Sections 364A I.P.C, Police Station Kairana, District Shamli.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of six months from the date of production of a certified copy of this order, if there is no legal impediment.
