By means of this writ petition, the petitioner has challenged the statement of account and imposition of interest for recovery of loan.
The petitioner has earlier filed writ petition being Writ C No.56772 of 2017 before this Court raising the dispute with regard to the recovery of proceeding that no opportunity of hearing has been given to the petitioner. This court while disposing of the writ petition vide order dated 29.11.2017 gave an opportunity to the petitioner to approach the authority who will consider the claim of the petitioner. Pursuant to the aforesaid order, the statement of account which is again issued is being disputed by the petitioner. What are terms of the loan is not before this Court. Apart from this question of fact and the terms of agreement, if there is any breach of agreement between the parties, either of the party is at liberty to approach the competent court of civil jurisdiction for redressal of breach of such agreement. In writ petition this question of fact can not gone into.
The writ petition lacks merit and is accordingly dismissed.
