JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the convict, through his father, has prayed that he be enlarged on temporary bail on the ground that he wants to attend marriage of his brother, which is scheduled to be held on 30.04.2012.
Pursuant to the earlier order passed by this Court, the learned APP Shri Pandya, based on the report received by him from the Meghaninagar Police Station, Ahmedabad, has submitted that the ground mentioned in the application is genuine.
From the jail report, it transpires that on earlier occasion, whenever the applicant was enlarged on temporary bail or on furlough, he has surrendered in time before the jail authority.
Considering the totality of the facts, it is ordered that the applicant shall be enlarged on temporary bail for a period of one week from the date of his actual release on personal bond of Rs.5000/- (Rupees Five Thousand Only) with one surety of like amount, with the further direction that the applicant-convict shall surrender before the concerned jail authority on expiry of the period of temporary bail granted by this Court.
The application is allowed to the aforesaid extent. Rule made absolute accordingly. Direct service today is permitted.
