Present application is filed by the convict through his nephew seeking temporary bail for a period of 30 days for completing house repair work.
2. Learned Advocate for the applicant submitted that convict was granted temporary bail from 14/04/2012 to 27/04/2012 for the same purpose i.e. repair of house but the same could not be completed. Learned Advocate for the applicant invited attention of the Court to the bill dated 17/04/2012 whereby the building material is purchased worth Rs.24,000/- Learned Advocate for the applicant requested that to enable him to complete the house repair work, this application may be allowed.
2. Rule.
Mr.Patel, learned Additional Public Prosecutor waives service of notice of Rule. Learned APP makes available for perusal the jail remarks. From the jail remarks, it transpires that convict is undergoing life imprisonment for the offence punishable under Sections 302 of the IPC. By now, convict has undergone 05 years, 03 months and 28 days. The convict has enjoyed temporary bail on five different occasions and has reported in time. He has enjoyed furlough and parole once on different occasion and has reported in time.
3. For the contents of the application, the same is allowed. The applicant is, therefore, ordered to be released on temporary bail for a period of 30 DAYS from the date of his release on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) before the Jail Authorities on certain conditions that he will;
a) not leave the State of Gujarat.
b) not indulge in any illegal activity.
c) surrender before the Jail Authorities in time.
4. Rule is made absolute. Direct Service today is permitted.
