Ashwinkumar vs Jerambhai

High Court Of Gujarat|20 July, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Draft amendment granted.
Rule.
Mr.Parmar, learned Counsel appears for respondent No.1 and waives service of notice of Rule. Mr.Dave, learned AGP for respondents No.2 and 3 and Mr.Dakshesh Mehta, learned Counsel for respondents No.4 and 6, waive service of notice of Rule for the respective respondents.
Mr.Bambhani, learned Counsel for the applicants states that the other respondents have no objection, if the applicants are permitted to be impleaded as party-respondents.
It appears that the only objection is by the main petitioner - respondent No.1 herein, who has preferred the petition.
Considering the facts and circumstances and the prayer made in the main petition being Special Civil Application No.1543 of 2006, we find that if, without prejudice to the rights and contentions of both the sides in the main petition, the applicants are permitted to be added as party-respondents, no prejudice would be caused and the Court may be in a position to effectively adjudicate the issues, which are raised in the petition, after hearing all affected parties.
Hence, the applicants are permitted to be impleaded as party-respondents, without prejudice to the rights and contentions of both the sides in the main petition, at their cost.
The application is allowed to the aforesaid extent. Rule made absolute accordingly.
