Vijayakumar, Advocate for R3) …Respondents This Miscellaneous First Appeal is filed under Section 173(1) of the Motor Vehicles Act, against the judgment and award dated 23.3.2015 passed in MVC No.124 of 2010 on the file of the Senior Civil Judge, Principal JMFC, MACT, Tarikere, partly allowing the claim petition for compensation and seeking enhancement of compensation.
This Miscellaneous First Appeal coming on for Admission, this day, the Court delivered the following:
J U D G M E N T This appeal is filed by the appellant-claimant seeking enhancement in the compensation. In the claim petition filed by the claimant seeking compensation for the injuries suffered in the road traffic accident on 7th June 2010, the Motor Accident Claims Tribunal, Tarikere, by its order dated 23rd March 2015 passed in common judgment in MVC No.124 of 2010 and connected petitions, awarded the compensation of Rs.36,400/-. Being not satisfied with the compensation awarded the appellant-claimant has preferred this appeal.
2. After arguing the matter for considerable length of time, both the learned counsel submit that the appeal may be disposed of by awarding globally a sum Rs.50,000/- in addition to what has been awarded by the Tribunal. Placing the submission made by both the learned counsel on record, the appeal stands disposed of by awarding global sum of Rs.50,000/- in addition to what has been awarded by the Tribunal.
