Learned A.P.P. Mr.J.K. Shah waives service of Rule for the respondent-State.
In view of the averments made in paragraph Nos.3,4,5 and 6 and necessity as shown by the applicant more particularly, in paragraph No.6 about his family circumstances, I am inclined to allow this application.
Accordingly, the application is allowed in terms of paragraph 9(A) to the extent that condition No.3(e) of order dated 13.07.2011 passed in Criminal Misc. Application No.8467 of 2011 stands deleted, keeping other conditions as they are. Rule is made absolute accordingly.
