Order in Appeal From Order No.440 of 2011:-
1. It is submitted by learned advocates for the respective parties that if necessary direction is given for expeditious disposal of the suit being Special Civil Suit No.56 of 2008, then they will not invite reasoned order.
2. In view of above, Senior Civil Judge, Gandhinagar is directed to dispose of Special Civil Suit No.56 of 2008 within one year from receipt of present order.
3. It is submitted by learned advocates for the parties that they will give full cooperation for expeditious disposal of the suit.
4. It is clarified that the trial court shall decide Special Civil Suit No.56 of 2008 in accordance with law and without being influenced by the order passed by this Court today.
5. With the above direction and observation, the Appeal From Order stands disposed of. Direct service is permitted.
Order in Civil Application No.12135 of 2011 in Appeal From Order No.440 of 2011:-
In view of order passed in Appeal From Order No.440 of 2011, no order is required to be passed in the Civil Application. The Civil Application stands disposed of accordingly.
