Heard Sri Pawan Kumar, learned counsel for petitioners as well as Sri Jitendra Kumar Jaiswal, learned AGA for the State and perused the record.
This habeas corpus writ petition has been filed by corpus- petitioners through their mother Smt. Jyoti Patel with the allegation that petitioners have been illegally detained by opposite party No. 4 who is grandfather of both petitioners(corpus) and opposite party nos. 5 & 6 who are their uncles(Chacha).
From perusal of Annexure 3 to this petition, it is apparent that Smt. Jyoti Patel, mother of petitioners is an accused in Case Crime No.04 of 2020 under section 302,201, 120B IPC registered at police station Chawk, District Maharajganj for murder of her husband and she was granted bail by this Court vide order dated 21.10.2020 by a co-ordinate Bench of this Court. Since the mother of petitioners is accused in murder of her husband(father of petitioners) and petitioners are living with respondent no. 4 who is their grandfather, this Court finds no ground for interference.
The instant Habeas Corpus Writ Petition is dismissed accordingly.
