1. Case called out. None appeared on behalf of petitioner. Sri Tejaswi Mishra, Advocate, holding brief of Sri Krishan Pahal, learned counsel for the respondent nos. 2 and 3 is present. However, we ourselves have perused the record.
2. By means of the present writ petition, petitioner has sought the following reliefs :
"a) Issue a writ, order or direction in the nature of Certiorari quashing the selection process pursuant to the advertisement dated 4th March, 2014, advertising one post of Assistant Professor ( Lecturer ) in Botany, which is reserved for the Scheduled Caste candidates ( annexure -2 to the writ petition), calling the record and further, quashing the consequential selection and appointment.
b) Issue a writ, order or direction in the nature of Mandamus restraining the respondents authorities from completing the selection proceeding in reference to the post of Assistant Professor ( lecturer) in Botany in Chaudhary Charan Singh University, Meerut and the University, including Executive Council may also be restrained from finalizing the selection process.
c) Issue a writ, order or direction in the nature of Mandamus directing the respondents- authorities to re-advertise the post of Assistant Professor (lecturer) in Botany without any reservation in compliance of the judgement of this Hon'ble Court within the period as fixed by this Hon'ble Court and proceed for selection accordingly."
3. However, we ourselves have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for the petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
