Heard learned AGA for the State and Sri R.C. Chatruvedi appearing on behalf of the respondent no. 2 and perused the record.
It is contended by the learned counsel for the respondent no. 2 that this is the second transfer application. The Criminal Misc. First Transfer Application No. 394 of 1999 has already been dismissed on 23.4.2003. In this case no interim order has been passed. This is too old matter. This transfer application has been filed by applicant Ashwani Sharma (Pappu) @ Meena with a prayer that the proceedings of Case No. 1230 of 1996 arising out of case crime no. 100/1996 under Section 147, 148, 149, 323, 325, 326, 307, 427, 452, 504 and 506 I.P.C., pending in the Court of learned 1st Additional Chief Judicial Magistrate, Agra may be transferred to another district such as Mathura.
From the perusal of the record, it appears that there is no good ground for transferring the above mentioned case from Agra to another district, such prayer is refused.
Accordingly, this transfer application is dismissed.
