Heard learned counsel for the applicants, Sri Sandeep Saxena, learned counsel for the informant and learned A.G.A. for the State.
The instant anticipatory bail application has been filed with a prayer to grant anticipatory bail to the applicants, Ashwani Kumar, Rakesh Kumar and Sunita, in Case Crime No. 550 of 2020, under Sections- 498A, 323, 504, 506, 352, 336, 308 I.P.C. and Section 3/4 of Dowry Prohibition Act, Police Station- Kavi Nagar, District- Ghaziabad.
The applicants have earlier challenged the charge-sheet by filing Application U/S 482 Nos. 6521 of 2021 and 2324 of 2021 before this Court. The orders have not been annexed with the anticipatory bail application.
In view of paragraph 43 (8) of the judgement dated 05.04.2021 passed by this Court in Criminal Misc. Anticipatory Bail Application U/S 438 Cr.P.C. No. 2110 of 2021, Shivam Vs. State of U.P. and Another, this anticipatory bail application is not maintainable and deserves to be rejected.
It is accordingly, rejected.
