Heard learned counsel for the petitioners and perused the record.
In view of the order proposed to be passed, notices need not issue to the private-respondents.
The petitioners are before this Court for a direction to the respondent no. 1/Civil Judge (Senior Division) F.T.C., Allahabad to decide the case no. 123 of 2004 (Mangala Prasad Verma vs. Ashwani Kumar) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the respondent no. 1/Civil Judge (Senior Division) F.T.C., Allahabad to consider and decide the aforesaid case in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
