Ashwani Kumar Vishwakarma And Others vs Sri Raghuvendra Singh

High Court Of Judicature at Allahabad|27 February, 2018
|

JUDGMENT / ORDER

Court No. - 59
Case :- CONTEMPT APPLICATION (CIVIL) No. - 1084 of 2018 Applicant :- Ashwani Kumar Vishwakarma And 7 Others Opposite Party :- Sri Raghuvendra Singh, Advocate General Counsel for Applicant :- Phool Chandra Singh,Phool Chandra Singh,Sumitra Singh
Hon'ble Yashwant Varma,J.
Heard learned counsel for the applicant.
Admittedly the writ petition preferred by him was dismissed on 15 September 2017. However, insofar as relief No. (1) is concerned, the Court had observed that the Advocate General would consider the claim of the applicant-petitioner for ad hoc appointment as and when vacancies arise in future.
From a perusal of the direction as framed, it is evident that the claim for consideration would arise only in case the Advocate General deems it fit to make ad hoc appointments. It is only when ad hoc appointments are sought to be made that a cause of action would arise. Presently on the state of the record as it exists today, the Court finds no material which may even remotely indicate that the Advocate General has taken a decision to make ad hoc appointments.
In view thereof this petition is clearly premature. It is accordingly dismissed with liberty to the applicant to approach again in case cause of action arises.
