Court No. - 2
Case :- WRIT - A No. - 9178 of 2019 Petitioner :- Ashwani Kumar Rai Respondent :- State Of U.P. And 7 Others Counsel for Petitioner :- Priya Ranjan Rai Counsel for Respondent :- C.S.C.,Hemendra Kumar Mishra
Hon'ble Suneet Kumar,J.
Heard learned counsel for the parties.
Petitioner by the instant writ petition seeks the following relief:
"Issue a writ, order or direction in the nature of mandamus directing the respondents authority to consider the claim of petitioner on the post of Tuberculosis Health Visitor (TBHV) in Rajkiya TB Clinic, Mau by cancelling the appointment of respondent no. 8."
On specific query, learned counsel for the petitioner submits that petitioner would become eligible to apply against the post in case the eighth respondent, against whom enquiry is pending, is terminated.
Learned Standing Counsel submits that the petition is premature and petitioner has no legal right either against eighth respondent or claiming any appointment.
The writ petition being premature is, accordingly, dismissed. No cost.
