Heard Shri Neeraj Kumar Srivastava, learned counsel for the petitioners and Shri Rajan Upadhyay, holding brief of Shri Ramesh Upadhyay, learned counsel for Motilal Nehru National Institute of Technology, Allahabad.
The petitioners are before this Court assailing the impugned cancellation notice dated 24.1.2018 passed by the third respondent, Registrar of Motilal Nehru National Institute of Technology, Allahabad.
Learned counsel for the petitioners submits that Motilal Nehru National Institute of Technology, Allahabad (in short, the Institute) published an advertisement dated 28.2.2014 for filling up 26 posts of Junior Assistant in the Institute. The petitioners applied for the said post and were issued admit card for appearing in the written test, which was scheduled to be held on 12.9.2015. They have appeared in the said examination and qualified the same. Thereafter, they were issued the admit card for appearing in the second paper (computer typing) to be held on 15.11.2015. They have also appeared in the said test and qualified the same. The petitioners were also called for interview on 3.12.2015. By the impugned notice dated 24.1.2018 the Institute has cancelled the recruitment process for 25 posts of Junior Assistant due to administrative reasons, except for one post advertised under PWD category but the administrative reasons have not been disclosed in the cancellation notice. The said advertisement was made against the sanctioned posts and these posts are still lying vacant.
The Court has proceeded to examine the record in question and finds that the competent authority of the Institute has cancelled the recruitment process for 25 posts of Junior Assistant due to administrative reasons, except for one post advertised under PWD category and those candidates, who have applied against the said posts and paid the requisite fee, have been directed to check their e-mail as mentioned in their application forms for providing account details for online refund of fee. The petitioners do not have any indefeasible right to assail the validity of the impugned cancellation notice and as such, no interference is required in the matter.
Consequently, the writ petition sans merit and it is accordingly dismissed.
