1. Heard Sri Ashok Khare, learned Senior Advocate assisted by Sri Sunil Kumar Singh, learned counsel for petitioner and learned Standing Counsel for respondents.
2. Writ petition is directed against suspension order dated 02.04.2018 passed by Commissioner-cum-Secretary, Board of Revenue, Lucknow placing petitioner under suspension since he was arrested on 05.12.2017 pursuant to a first information report being Case Crime No. 413 of 2017, under Sections 419, 420, 467, 468, 471, 120B, 34 and 477A IPC and disciplinary inquiry is contemplated.
3. It is not disputed by learned Senior Advocate appearing for petitioner that suspension can be made not only in criminal investigation, inquiry and trial is pending but also in contemplation of departmental inquiry. Further, order of suspension is not shown to have been passed by any incompetent authority and there is no allegation of mala fide. Hence, we do not find any reason to interfere with impugned order of suspension.
