Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material brought on record.
By way of the instant application, the applicant seeks bail in Case Crime No.0590 of 2018 under Sections 420, 467, 468, 471, 504, 506 I.P.C., Police Station Badaut, District Baghpat.
Allegations have been made against the applicant that he induced the victim-informant to pay Rs.2,70,000/- so that the victim-informant may avail Class IV service in the health department. The victim-informant paid Rs.2,00,000/- from his account and gave Rs.70,000/- in cash. Thereafter, the forged appointment letter was issued by the applicant in company with another co-accused which was found to be forged. On demand of money, threat was extended by the applicant.
Contention is that some money was lent by the applicant to the informant who in order to exert pressure has concocted this false story which is absolutely false. The applicant does not bear any criminal history and is languishing in jail since 02.09.2018.
Per contra, learned A.G.A. has opposed the prayer for bail and has submitted that specific information was given and letter was addressed to Vice-President of India, whereupon the case was instituted which was duly investigated into by the Investigating Officer whereupon the case of fraud was discovered by the Investigating Officer, for the reason that money to the tune of Rs.2,70,000/- was obtained by the applicant and pursuant thereto forged appointment letter was given to the informant which aspect of the case cannot be viewed with leniency and the complicity of the applicant in this case cannot be denied.
Considered the submissions and perused the material brought on record. No good ground is made out for bail.
Accordingly, the bail application is rejected.
