1. Heard learned counsel for the applicant, learned A.G.A for the State and also perused the record.
2. This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early decision of Criminal Case No. 608 of 2011 (State Vs. Ashutosh Chaudhary), arising out of Case Crime No. 608 of 2011, under Sections 302, 307, 323, 504, 506, 34 IPC and Section 7 Criminal Law Amendment Act, Police Station Cantt, District Varanasi, pending before the Juvenile Justice Board, Varanasi.
3. Learned counsel for the applicant submits that the applicant is a juvenile and that his trial is pending before the Juvenile Justice Board, Varanasi since 2011. At present, the trial is at the stage of recording the testimony of the doctor. However, such testimony has not been recorded.
4. Considering the fact that the trial has remained pending since 2011, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, if there is no other legal impediment.
