Heard learned counsel for the petitioners.
The petitioner is before this Court for a direction to the court below, namely, Additional Civil Judge (Senior Division), Court No.2, Varanasi to decide Original Suit No.862 of 2014 (Ashutosh Agrawal and others Vs. Smt. Mohini Tiwari) within stipulated period.
It is argued by the learned counsel for the petitioners that the issues were framed and the parties were also examined and the matter is ready for final disposal. It is further argued that large number of dates were fixed in the matter but till date no final hearing in the suit has taken place.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid suit in accordance with law expeditiously and preferably within a period of one year from the date of production ofself attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
