By order dated 1.10.2013 passed in Writ A No. 1488 of 2011 filed by the applicant, a direction was issued to the competent authority to examine the claim of the applicant, a daily wager, as to whether he is entitled to the minimum of pay scale having regard to the judgement of the Apex Court in State of U.P. and others Versus Putti Lal, 2002(2) UPLBEC 1595.
On matter being taken up today, Sri Neeraj Upadhyay, learned Additional Chief Standing Counsel has placed on record the instructions received by him from the opposite party, according to which, an office order was issued in purported compliance of the order of the writ Court. By the said order, the claim of the applicant for regularisation/payment of the minimum of the pay scale has been rejected. The order recites that a Committee was constituted to examine his claim and according to which, the petitioner had not worked for 240 days in a year. The report of the Committee has also been placed on record, according to which the applicant has not worked in the years 2014, 2015 and 2016 at all, whereas, he worked only for 23 days in the year 2017.
Since a decision has already been taken by the opposite party, therefore, this Court does not find any wilful disobedience of the order of the writ Court.
The contempt application is accordingly consigned to record. However, it shall be open to the applicant to challenge the order rejecting his claim, in case, he feels aggrieved thereby.
