Heard Sri Srijan Mehrotra, learned counsel for the petitioner.
Petitioner is before this Court with a request to direct the learned Principal Judge, Family Court, Kanpur Nagar for passing the final order on the application No. 20-Ga-2 dated 5.7.2018 in Guardians & Wards Case No. 66/70 of 2016 (Ashraf Ali Vs. Smt. Shameem Ali alias Shameem Akhtar).
Learned counsel for the petitioner states that on account of pendency of aforesaid application, the applicant is suffering irreparable loss. He has also requested on the basis of pleadings set up before this Court that the application which he has moved for preponing the date fixed in the aforesaid application as on 15.9.2018 before the Principal Judge, Family Court, Kanpur Nagar, may be decided expeditiously.
In the facts and circumstances of the case, without issuing notice to the second respondent, the writ petition stands disposed of asking the Principal Judge, Family Court, Kanpur Nagar to look into the grievance of the petitioner and pass an appropriate order firstly to prepone the date and in case, the date is preponed then after issuing notice to the defendant opposite party, the aforesaid application No. 20-Ga-2 may also be decided at the earliest.
