Mr.M.B.Gandhi, learned counsel for the petitioners, has submitted that it was not the case of the respondent original plaintiff that he has become the owner of the suit property by way of adverse possession, but both, the Trial Court and the lower Appellate Court, have recorded findings that the respondent has become the owner of the suit property by way of adverse possession, therefore, the impugned order deserves to be stayed.
Notice returnable on 23.09.2009. The execution and implementation of the judgment and order dated 17.07.2008 passed in Miscellaneous Civil Appeal No.725 of 2006 by the lower Appellate Court shall remain stayed till then.
