This is a petition seeking a direction for expeditious disposal of A.S.No.85/2013 pending before the Sub Court, Irinjalakkuda. 2. The petitioner submits that he instituted O.S.No.203/2011 seeking injunction against defendants from causing any obstruction to the works carried out by the petitioner. The defendants entered appearance and filed a counter claim. After considering the rival contentions, the court dismissed both the suit and the counter claim. The petitioner submits that he has filed A.S.No.85/2013 against the judgment and decree dismissing the suit. His only grievance is that unless the appeal is heard, it will cause irreparable loss and injury to him.
3. In the light of the order that is proposed to be passed by this Court, notice to the respondent is unnecessary. After considering various aspects it is felt that this petition can be allowed.
Hence the petition is allowed and the Sub Court, Irinjalakkuda is directed to take up A.S.No.85/2013 pending before the Sub Court, Irinjalakkuda and dispose it of on merits as expeditiously as possible, at any rate, within a period of six months from the date of receipt of a copy of this judgment.
