(Criminal Misc. Bail Application No. 1 of 2019) Heard learned counsel for the appellant as well as learned A.G.A. for the State and perused the record.
Vide order dated 22.08.2019 non-bailable warrant was issued against the appellant- Ashok. The report of Chief judicial Magistrate, Meerut dated 16.09.2019 shows that the appellant has been arrested and has been sent to jail. It is further submitted by learned counsel for the appellant that the appellant was not advised to appear before this Court by his counsel, as his previous counsel was died due to which non-bailable warrant has been issued against the appellant and now he is in jail since 13.09.2019.
Considering the facts and circumstances of the case, in our view, the appellant may be released on bail.
The bail application is allowed.
Let the appellant (Ashok) convicted in Sessions Trial No. 383 of 1991, under Section 302 I.P.C. read with Section 34 I.P.C., (State Vs. Ashok and Another) P.S.- Daurala, District Meerut, be released on bail on his furnishing a personal bond of Rs 10,000/- and two sureties each in the like amount to the satisfaction of the C.J.M. concerned.
The photo copy of bail bonds so furnished be transmitted to this Court.
On the request of learned counsel for the appellant, list this case on 15.10.2019.
