Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos. 1 & 2 and Sri Shashi Kant Verma, learned counsel for respondent nos. 3 & 4.
The petitioner has preferred the present petition inter-alia with the following prayer :
"(i) issue a writ, order or direction in the nature of mandamus directing the respondent authorities to compute the amount payable to the petitioner's husband towards gratuity in terms of the scheme and released the same to the petitioner with 12% interest within stipulated period.
(ii) issue a writ, order or direction in the nature of mandamus directing the respondent no. 3 to consider and decide the representation of the petitioner dated 25.10.2021 within stipulated period."
It is admitted between the parties that the petitioner's case is squarely covered by the judgement rendered by this Court in Writ A No.17399 of 2019 ( Usha Rani Vs. State of U.P. and others) decided on 7.11.2019 and Writ A No.15052 of 2021 (Shiv Kumari Vs. State of U.P. and 5 others) decided on 18.11.2021.
With the consent of learned counsel for the parties, the writ petition is being disposed of at the admission stage itself.
In the facts and circumstances, petitioner is permitted to make a fresh representation ventilating all his grievances before the respondent no. 3 - Basic Shiksha Adhikari, District - Farrukhabad along-with certified copy of this order within a period of three weeks from today. If such a representation is made, the respondent no. 3 is directed to pass appropriate order strictly in accordance with law within a further period of two months in the light of the aforesaid two judgements.
With the aforesaid observations, present writ petition is disposed of finally.
It is made clear that this Court has not entered into the merits of the case and thus it is for authority concerned to take a decision independently in accordance with law.
