By means of the present writ petition, petitioner has sought following relief:
(i) To issue writ order or direction in the nature of mandamus commanding the respondents to allot the plot no. 8 to the petitioner in Sector- 16-B of Sikandara Yojna, Agra of Avas Evam Vikas Parishad, Agra Zone, Agra on the application dated 29.5.2004 moved by the Petitioner (Annexure No. 4 to the Writ Petition) and recommneded by letter dated 01.06.2004 by the Property Manager/ Assistant Housing Commissiner, Agra Zone, Agra, (Annexure No. 6 to the Writ Petition).
(ii) To issue writ or direction in the nature of mandamus commnading and directing the Respondents not to Allot the Plot No. 7, 8, 9 of Sector 16-B of Sikandara Yojna, Agra of Avas Evam Vikas Parishad, Agra Zone, to any person till the disposal of the writ petition."
In this writ petition the respondent was restrained vide interim order dated 15.7.2004 from allotting the plots in question, to any person with liberty to apply for extension, vacation, modification and/or variation of this order in the presence of other side.
In the meantime, impleadment application was filed on behalf of one Diwan Singh, praying for impleading him as a party to the writ petition. He also filed his counter affidavit.
From perusal of the order sheet dated 29.5.2004, it is apparent that on the said, date illness slip was filed by the learned counsel for the petitioner and the case was passed over giving last chance to the petitioner's counsel to appear in the matter. Interim order dated 15.7.2004 has not been extended. Today when the matter is taken up, none has appeared on behalf of the parties.
We have perused the record and don't see any justification to interfere in the matter.
The writ petition has no merits and, accordingly, dismissed. Interim order, if any, stands vacated.
