This is a second PIL by the petitioner complaining of encroachment by respondents 6 to 11 over land recorded as 'Bhita'.
On the petition being filed, learned Standing Counsel had been directed to obtain instructions. The instructions received are to the effect that the order passed in proceedings under Section 122B of the U.P.Z.A. & L.R. Act cannot be implemented on account of pendency of a suit for declaration, wherein an order of status quo granted by the High Court is operative.
Under the circumstances, the relief prayed for cannot be granted in the aforenoted facts and circumstances.
The PIL is dismissed.
