Court No. - 6
Case :- WRIT - A No. - 22710 of 2018 Petitioner :- Ashok Kumar Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Satya Prakash Rathor,Ashish Pandey Counsel for Respondent :- C.S.C.
Hon'ble Yashwant Varma,J.
Heard learned counsel for the petitioner and the learned Standing Counsel.
This petition has been preferred seeking issuance of a direction for extension of the services of the petitioner.
Undisputedly the petitioner was appointed as a Counsellor on contract basis. As per the own admission of learned counsel, this contract was not extended after 30 September 2014. It appears that certain complaints were made against the petitioner which were made subject matter of an enquiry. On the conclusion of the enquiry the District Magistrate Mahoba on 24 February 2016 has passed an order holding that the charges levelled against the petitioner were unfounded and that his services may be considered for extension.
Despite repeated queries, learned counsel was unable to draw the attention of the Court to either the contract or any other material which may have established a right of extension inhering in him. In the absence of the contract the learned counsel for the petitioner was also unable to disclose either the original term of the contract or whether it would still subsist.
Consequently and on a failure to establish a right of renewal, this Court finds no ground to entertain this petition, which shall stand dismissed.
