Heard learned counsel for parties.
Learned counsel for parties are ad idem that this petition would merit disposal in light of the decision rendered in Yogendra Pratap Singh and 4 others Vs. State of U.P. and 3 others [Writ A No.1054 of 2021]. That petition was disposed of as under:-
"Heard learned counsel for parties.
The prayer as made in this petition reads thus:
"I. Issue a writ order or direction in the nature of Mandamus commanding the Respondent no.4 (authority Concerned) to pay him minimum pay scale of Group 'D' of Petitioner Post and also to regularized on the post of which Petitioners are working in the forest department.
II. Issue a writ order or direction in the nature of Mandamus directing the Respondents authority to decide the representation of the Petitioners (Annexure No. 2 to this writ Petition."
Learned Standing Counsel submits that subject to all contentions on merit being kept open, the claim of the petitioners for payment of minimum in the pay scale and regularization, in light of the decision of the Supreme Court rendered in Sabha Shanker Dube Vs. Divisional Forest Officer and Others [Civil Appeal No. 10956 of 2018 decided on 14 November 2018], shall be duly evaluated and a final decision communicated with expedition and preferably within a period of four months from the date of presentation of a duly authenticated copy of this order along with a copy of the writ petition and its enclosures. Statement so made is recorded and accepted.
Petition stands disposed of accordingly."
Accordingly this petition stands disposed of on similar terms.
