Heard learned counsel for the petitioner, Mr. Rameshwar Prasad Shukla, learned counsel for the respondent no. 4 and learned Standing Counsel for the respondent-State.
Petitioner has filed the present writ petition for mandamus directing the respondents to consider the petitioner regarding his selection on the post of Panchayat Sewak in the Gram Panchayat, Bankat, Block Tahbarpur, Tehsil- Nizamabad, District- Azamgarh.
In view of the Government Order dated 25th July, 2021 petitioner has placed the resolution of the Gaon Sabha which is Annexure No.3 to the writ petition by which the resolution was passed in favour of the petitioner but Gaon Sabha has passed another resolution dated 25.10.2021 in favour of respondent no.5 (Annexure No.4 to the writ petition) which is not according to the aforesaid Government Order. Petitioner has submitted a representation before respondent no.2 for redressal of his grievance.
In view of the facts and circumstances, this writ petition is finally disposed of directing the respondent no.2- District Magistrate, Azamgarh to consider the representation of the petitioner in light of the Government Order dated 25.7.2021 and pass an appropriate order within a period of three months from the date of production of certified copy of this order before him.
With the above observations, the writ petition is finally disposed of.
