Heard the learned counsel for the petitioner, learned A.G.A. and perused the record. This petition has been filed by the petitioner with a prayer to quash the entire proceedings as well as congizance order dated 15.12.2016 passed by the Additional Chief Judicial Magistrate, Railways, Agra in Case Crime No. 1663 of 2016 in Case No. 11714 of 2016 (State Versus Ashok Kumar) under section 160(2) of Railways Act, P.S. R.P.F. Agra Fort, district Agra.
It is the submission of the learned counsel for the petitioner that the petitioner is willing to pay the damage cost to the Railways.
In view of the above submission this petition is disposed of with a direction to the court concerned that in case the petitioner moves an application before the court concerned within a period of three weeks from today, the same shall be heard and disposed of by the court convened within three months thereafter by a speaking and reasoned order.
The a period of three months no coercive action shall be taken against the petitioner.
